1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Schumann & Lasch GbR("Purchaid", "we", "us") governing access to and use of the Purchaid website, applications, and related services. By accessing or using the Service, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. The Service
Purchaid provides an AI-assisted product discovery and shopping advisor. Recommendations, prices, availability, and product information may be inaccurate, incomplete, or outdated. Purchaid does not sell products directly unless explicitly stated. We are not responsible for third-party merchants, listings, or transactions.
4. Accounts and guest use
You may use certain features as a guest or by creating an account. You are responsible for activity under your account and for keeping access credentials secure. Notify us promptly at support@purchaid.com if you suspect unauthorized access.
5. Acceptable use
You agree not to:
- use the Service unlawfully or to harm others;
- attempt to probe, scrape, or reverse engineer the Service without permission;
- submit malware, spam, or abusive content;
- interfere with security, rate limits, or infrastructure;
- misrepresent your identity or affiliation.
We may suspend or terminate access for violations.
6. Your content and data
You retain ownership of content you submit, but you grant Purchaid a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, modify, display, distribute, and create derivative works from your content and related data as needed to operate, improve, promote, and commercialize the Service.
You acknowledge that we may use, share, and sell personal and usage data as described in our Privacy Policy, including for commercial purposes in the future where permitted by law.
7. Affiliate and third-party links
Purchaid may earn commissions when you click outbound product or merchant links. Third-party sites are governed by their own terms and privacy practices.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUT MAY BE WRONG; YOU ARE SOLELY RESPONSIBLE FOR PURCHASE DECISIONS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURCHAID AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) EUR 100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Termination
You may stop using the Service at any time. We may modify, suspend, or discontinue the Service, or terminate your access, with or without notice. Sections that by nature should survive will survive termination.
11. Governing law
These Terms are governed by the laws of Germany, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence remain unaffected where applicable. Exclusive place of jurisdiction for merchants is Dresden, Germany, where permitted by law.
12. Changes
We may update these Terms from time to time. Continued use after the effective date of updated Terms constitutes acceptance where allowed by law.
